Policies

We offer a full refund on much of our jewelry and loose gemstones. Items that cannot be refunded include: custom designed orders (where the customer worked with us to design a new piece of jewelry, or sent in materials to be used in their piece); jewelry that is set with a diamond larger than .30 carats; rings that have been resized; and jewelry that has been purchased through a financing plan.

To be eligible for refund, please contact us within 14 days of receiving your order; the piece must arrive back to us in its original, unaltered state.

Jewelry that has been damaged, resized, or otherwise altered in any way is not eligible for refund. If you have any questions regarding whether or not a particular piece can be returned for refund, feel free to contact us.

The customer is responsible for any fees associated with returning their item(s), including shipping costs, duties, brokerage fees, etc. These fees, if applicable, are non-refundable. We cannot be held responsible for shipments that have been lost or damaged during return. We highly recommend using a shipping service that includes tracking and insurance.

1 Free Resize

We want to simplify your online ring buying experience and get you wearing a ring that fits properly. That’s why we provide 1 free resize with all of our rings. This includes wood inlaid rings and other rings that cannot be traditionally resized. All that we require is that you send the original, unaltered ring back to us within 60 days of receiving it, and cover the costs of shipping.

If your wood inlaid ring is made in a non-traditional metal, such as titanium or zirconium, the ring will have to be remade from scratch. But, our 1 free resize policy still applies. Gold rings that are inlaid with wood can usually be traditionally resized once the wood is removed. So, please keep in mind that when resizing wood engagement rings or wood wedding bands, the original piece of wood will have to be removed and then replaced with a new one. 

For rings that can be traditionally resized, it may be easier for you to take it to a local jeweler to have its size altered. If you are unsure of your size, please take advantage of our ring sizers, which are offered free with the purchase of any ring.

All of our jewelry includes a lifetime warranty against manufacturing defects. If your item has what you believe to be a manufacturing defect, please send it back to us for inspection. If there is a problem with your item due to manufacturing, we will repair it free of charge or replace the item where appropriate. If we find that the damage was caused by something other than a manufacturing defect, we will let you know if repair services are available.

Please note that gemstones and organic materials, such as wood and pearls, have characteristics that are unique to the material being used. These characteristics include variation in wood grain, gemstone inclusions, etc. Slight variation from the product image should not be considered a defect, and is due to the nature of the materials and the nature of the handcrafting process.

Conditions

This warranty is valid only for the person who purchased the original piece of jewelry from us. Any repair or alterations done by anyone but us will void the warranty. This warranty does not cover damage done to the item, regular wear and tear, or loss of the item.

Lifetime Care for Wood and Stone Inlaid Rings

All of our rings inlaid with wood or crushed stone have been coated with a resin finish, and include a lifetime warranty for finish repair/touchups.

Charles and Colvard Moissanite Warranty

All of the white moissanites that are used in our jewelry are Charles & Colvard moissanites. Charles & Colvard moissanites 4mm and larger come with a warranty card, which can be used to register the moissanite at the Charles & Colvard website.

Insurance

You may want to consider having your jewelry insured. Jewelry is usually insured in one of two ways. The first is as a rider on your homeowners insurance policy. Many expensive items are not covered under basic homeowners insurance (including jewelry), but additional insurance coverage called scheduled personal property (also known as a rider or floater policy) may be available through your homeowners insurance company.

A popular alternative is insuring through a company that specializes in jewelry insurance, such as Jeweler’s Mutual Insurance Company. This type of company may be able to offer better coverage than a standard homeowners rider policy.

If you would like to proceed with a payment plan, add an item to your cart, proceed to the checkout page, and there will be an option on the checkout page to create a Partial.ly plan. Click the Partial.ly button, and follow their three easy steps to create your plan.

Things to note:

• We only offer payment plans in US dollars at this time.
• We do not accept returns/refunds on orders purchased through a payment plan.
• Payments must be made in full before production begins on your ring. Once paid in full, our regular production times apply.

We accept most major credit cards, Google Pay, Apple Pay, and PayPal. We use Stripe as our payment gateway (except for PayPal payments), which is among the most secure and reputable payment processors available. We also offer payment plans through Partial.ly. 

Your payment information is never stored on our servers. All card numbers are encrypted on disk with AES-256. Decryption keys are stored on separate machines. None of Stripe’s internal servers and daemons are able to obtain plaintext card numbers; instead, they can just request that cards be sent to a service provider on a static whitelist. Stripe’s infrastructure for storing, decrypting, and transmitting card numbers runs in separate hosting infrastructure, and doesn’t share any credentials with Stripe’s primary services (API, website, etc.).

Casavir Jewelry (“us”, “we”, or “our”) operates https://casavirjewelry.com (the “Site”). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site. We use your Personal Information for the completion of, sending, and following up on orders that you have placed. By using the Site, you agree to the collection and use of information in accordance with this policy.

INFORMATION COLLECTION AND USE

When registering on our Site or placing an order, we will ask you to provide us with certain personally identifiable information. This personally identifiable information includes: physical address, email address, and phone number. This information is used by us to contact you regarding an order that you have placed with us, as well as to fulfill your order. Payment information that you submit is handled by our trusted third party gateways (either Stripe or PayPal); payment information is not stored on Casavir servers.

LOG DATA

Like many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this data.

INFORMATION DISCLOSURE TO THIRD PARTIES

We do not sell, trade, or otherwise transfer your Personal Information to outside parties. This does not include trusted third parties (Stripe or PayPal, our payment processing gateways) who assist us in conducting our business or servicing you. We may also release your information for tax purposes, or when necessary, to comply with the law.

We may occasionally email you regarding your order.

COOKIES

Cookies are files with small amounts of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. Like many sites, we use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.

SECURITY

We use SSL encryption any time personally identifiable information is submitted or sent. Payment information (i.e. credit card, debit card, etc.) are processed by either Stripe or PayPal, both of which are secure payment processing gateways; no payment information is ever collected or stored on casavir.com servers.

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and [Casavir Jewelry] (“we,” “us” or “our”), concerning your access to and use of the casavirjewelry.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason.

We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Terms of Use to stay informed of updates. The Site is intended for users who are at least 13 years of age. PRODUCTS

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. Prices for all products are subject to change.

 

PURCHASES AND PAYMENT

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

GUIDELINES FOR REVIEWS

We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria:

(1) you should have firsthand experience with the product being reviewed;

(3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;

We may accept, reject, or remove reviews at our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions.

We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

 

MODIFICATIONS AND INTERRUPTIONS 

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site. 

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. 

You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

 

CORRECTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

 

INDEMNIFICATION

You agree to defend, indemnify, and hold Casavir Jewelry harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Site; (3) breach of these Terms of Use; (4) any breach of your representations and warranties set forth in these Terms of Use. 

 

USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. 

You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

 

GOVERNING LAW  

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of Ontario, Canada, applicable to agreements made and to be entirely performed within the Province of Ontario without regard to its conflict of law principles.
